Heber City Council Meeting December 6, 2012

I try to go to as many meetings as possible.  If I can't make it to the meeting personal, then I follow-up with someone who did and I read the minutes to create this blog entry.  You always have the option to read the minutes yourself at the link below.

Tonight the City's new policy for how public meetings are held was discussed in the Work Meeting.

Two documents were presented for consideration.  A short draft was presented by ROWLAND and a much longer draft was presented by MCDONALD.

A vote was then schedule for the next scheduled Regular Meeting.

In the Regular Meeting tonight, the City council finally defined the city's form of government:
  1. The powers of the municipality of Heber City is vested in a council consisting of six members, one of which is a mayor.
  2. The mayor and five council members shall be chosen at large by the qualified voters of Heber City.
  3. Heber City has a City Manager (created by ordinance and in accordance with state staute) who is a professional manager appointed by the governing body who has been delegated the administrative power and authority of the city to oversee daily operations.
The vote was as follows;
  • FOR - Patterson, Bradshaw and Rowland
  • AGAINST - McDonald and Mergist
This issue had bother many people for a long time and hats off to the City Council for getting this one right.

Look, if a city councilman is trying to get rid of the City Manager and give more power to the Mayor than we all need to keep an eye out on who shows up on the ballot for the next Mayoral Election...

I will be that EYE IN THE SKY and keep you posted.

Another meeting with Zions Bank talking about the water study.  Findings were presented showing the short-falls and where improvements can be made.

Prior to this, the council has been talking to this for over a year all about the culinary rates and secondary rates.

Devon McKrola was also at this meeting.  He is over the Wasatch Irrigation Company.  Nothing exciting, but as Zions continues to report on the study, it will be important to see what the City Council does with the information

This was a SPECIAL MEETING and I could not find the minutes online to link to this post.

In this meeting the APPROVAL was unanimous to return money to the businesses that had paid impact storm water fees.

The city had decided to bill storm water fees monthly and felt it import to return money to the businesses that would be double charged.  The fees will be returned with interest. Total to be refunded is $155,242.00.

This ends up being a positive city action reducing overall fees to businesses and further promoting the commitment by the city to further economic growth.

It was brought to the city councils attention in previous meetings that there was an issue with parking in the street during heavy snow removal.  The equipment could not do an adequate job if there were cars parking on the street for extended periods of time.

A Snow Clean-up ordinance was approved to clarify that whenever a snowplow was in effect that vehicles were not allowed to be park on the street for longer than 24-hours.

"Between Nov 15th and Apr 1st a person can not park or leave parked any vehicle on the cities paved portion of the street under the following circumstances:
  • If there is any amount of snow on the street
  • If it is snowing or has snowed within the past 24-hours
  • If the street hasn't been plowed since the snow fall.
The penalty is a ticket and if you keep doing it you vehicle may be impounded.

As part of this ordinance any non-motorized vehicle may not be parked on any street, alley, sidewalk, park strip, right away or any other public property.

It was pass unanimously.

I live in Timp Meadows and it will be interesting to see if this ordinance will even be enforced...

I try to go to as many meetings as possible.  If I can't make it to the meeting personal, then I follow-up with someone who did and I read the minutes to create this blog entry.  You always have the option to read the minutes yourself at the link below.

This meeting included a PUBLIC HEARING on the increase salary compensation for the city council  and mayor.

Several members of the public made comments including the ever LONG WINDED Tracy Taylor.

Councilman McDonald even suggested to have the Mayor's compensation increased beyond even that of the other council members because of all his hard work.  Makes me think Alan wants to be Mayor someday and is trying to give himself a "future" pay raise.

After several failed motion attempts they finally passed an increase of $400 per month for each council member.

The YES votes were:  PATTERSON, MERGIST and BRADSHAW.

The NO votes were: MCDONALD and ROWLAND.

Folks also showed up about the Airport Lease Rates.  If you remember an entry I wrote last month, the city needed to increase Lease Rates and decrease the Sales Price of Hangers to promote the sale of these Hangers.

Hanger leasees showed up and were upset (obviously) and it appeared to everyone that several council members and was unwilling to keep on track with the clear recommendation of the Airport Board.

Mergist motioned to leave the rates the same and McDonald seconded the motion.  Rowland added the leases needed to be increase even if it's not 60% recommended by the airport board.

The vote was taken to leave the rates the same.

The YES votes were:  PATTERSON, MERGIST and MCDONALD.

The NO votes were: BRADSHAW and ROWLAND.

Once again, a few "customers" of the city dictated their will over the best interest of the entire city.  Get a backbone will you guys!

Heber City Council Meeting July 19, 2012

I try to go to as many meetings as possible.  If I can't make it to the meeting personal, then I follow-up with someone who did and I read the minutes to create this blog entry.  You always have the option to read the minutes yourself at the link below.

Hangers at the AIRPORT were discussed.   Low lease rates is making it difficult to sell the hangers because it was so much more economical for someone to lease over buy.

So if the city council wants the hangers sold as originally planned, then the lease rates need to be increased to promote the benefit of future buyers to purchase.

It was discussed to raise the lease rates and lower the sales price to accomplish the objective of getting the hangers sold.  It is then agreed to put this topic on the next agenda a month later.  I will follow-up with what happens...

Later that night Mayor discussed increasing travel allowance, car allowance and insurance so the council members and the mayor could increase their compensation without having to have a public hearing.

Mergist and Rowland wanted greater accountability by actually re-structuring their pay into one package thus requiring a public hearing for any and all increases and as result, making the process completely transparent.

The council moved forward to add a salary increase of $250 per month to the public hearing agenda already scheduled for August 16th.

And they agreed to vote on increase of $150 per month for travel and insurance which would not need to be on any public hearing agenda but it was included.

I find it funny that any elect official is apprehensive to let the public know when their compensation has needs to be increased.

I also find it interested that the Mayor would even bring this increase up after the budget had already been approved.  What was the purpose for the after thought and who agreed with this kind of "after-the-fact" tactic?

I try to go to as many meetings as possible.  If I can't make it to the meeting personal, then I follow-up with someone who did and I read the minutes to create this blog entry.  You always have the option to read the minutes yourself at the link below.

It was talked about giving the city employees a cost of living allowance (COLA) at the expense of $106,000 to the city.

Employees had not received COLA in 2009 or 2010 and in 2011 it was 2% and in 2012 there was a salary adjustment.  So in 4-years the city employees had only received a cost of living adjustment once in four years.  It was agreed to put it in the budget and if it was received favorably at the public hearing, then it should be approved.
City employees are hard working and deal with challenging issues as they balance the needs of their families with the needs of the community.  I think this COLA should be approved and that the city can afford to take care of their employees to promote the retention of quality staff who always have the option of leaving and going into the private sector or even to a different city that pays better.

Lots of Budget Stuff going on this time of year at the city .  A request was made by a councilman about putting a system to record the meetings and making them available online so citizens could watch the meeting from any computer.  It was squashed, but why wouldn't they at least research want to make the meetings more available to all citizens of Heber?

There was also talk about how the School Board was upset about the unpaid impact fees for the High School.  They felt they shouldn't be charged because they are a government entity.  Mr. Shoemaker argued on behalf of the School Board to get the impact fees waived.  Years ago the council voted to waive the fees and it was voted down.  The High School owes approx. $168,000 in impact fees to the city.

The City is trying to treat everyone fairly and once again the School Board thinks they are above the rules.  I'm sure they want to save the money for FAT SALARIES on un-needed administrators instead of paying the city for services the High School received from the city.

What's nice is the cities attorney made it clear to everyone that the fee could NOT be waived.  They could be mitigated for improvements made by the high school that the city benefited from...

I need to follow-up with friends of mine that understand better how the School Board runs un-contested in our county and get back to you with more details.

Further discussion of Resolution 2012-03 (Compensation for Council Members on Boards) was struck down by McDonald, Mergist and Bradshaw.

Sad because this was the Resolution talking about City Council Members not taking compensation for sitting on Boards.  Too bad some go into public service just to line their own pockets...

It was also brought up how city staff time is wasted by certain city council members to draft policy that is unnecessary and a waste of time.  Our City Council was not elected to act as attorneys and write unnecessary policy.  What a total WASTE!

Heber City Council Meeting March 1, 2012

It's already March First!  Seems like only yesterday we were celebrating a new year...

I attended the work meeting today held from 6pm to 7pm.  Here's what they talked about:
  • they reviewed the airport board recommendation regarding landing fees, fuel flowage and FBO lease agreement.
  • reviewed proposed grazing of animals ordinance
  • discussed about mayor pro-temp
  • reviewed code of conduct
  • schedule a budget meeting
Here is what they did not talk about:
  • review the draft policy regarding the use of board compensation
  • reveiw draft letter to wasatch county school district
(not sure why these things got skipped)

I also stayed for the city council meeting that started at 7pm.

I made a comment during the public portion asking council to consider changing the night they meet so it does not conflict with the Wasatch County School Board meeting.

They agreed to look into it and put the item on the next work meeting.

Wasting time and public money when a councilman goes off on something without the consent of the entire council.  Why work on it and use city employee time if you don't have three councilman to vote on it...

Realizing you had nothing to do with the changes that were made in December/November, please provide me with the following information:
  1. Do you support the compensation change as passed in November?
  2. Will you vote to rescind the decision by the previous board if brought to a vote?  Will you make a motion that the issue be voted upon?
  3. Will you vote to have the Directors’ fees returned that were paid as a result of that change?  If the fees are impossible to be repaid, will you support a vote to suspend all future Directors’ fees until the value of what was paid in December is recouped by HCPL?
  4. Do you believe that HCPL Board Members should be paid a director fee for any month they fail to attend (or participate by phone) their monthly meetings?
Your candid response to these questions is sincerely appreciated.

Mr Heywood,

I have to admit that I came into this situation at a very inopportune time.  I'm afraid that I'm not totally up to speed on all of the issues relating to this increase in board members' compensation.  I will say that, thru sad experience, I have learned that I have to look at all the facts before I can make an informed decision.  There are always two sides to every story.  I have certainly heard from the public in the meeting yesterday.  I have read all of the comments on the e-petition as of an hour before the meeting.  I think there were 382 signees at that time.  I have not, however, heard all of the explanations from the board members about what went into the decision.  I owe it to the board to get all of the information they had in making the decision they did.  I admit that when I heard of the board's decision, I thought that the amount of the benefit seemed high.  At the present moment, I cannot tell you all of the answers that you seek.  It's my understanding that the committee that made the recommendation will be meeting the week after next to review their previous decision and make recommendations to the board.  I will find out for myself from individual board members what their take is on all of this.  I promise you that I will make an informed decision regarding this.  If a change is warranted, I will certainly vote for any changes.  As far as returning the funds paid to board members, I will also have to give that some consideration.  Things are complicated with the way Heber City Council handles board payments.  Right now, all Council members receive a pro-rata share of board payments.  I believe that any payments made would have gone to all five Council members last year.  Two of those members are no longer on the Council.  One of the key issues concerning splitting board fees among all of the council relates to attendance to board meetings.  I know that at least one member was on a board that paid for his service for a whole year when he only attended three of twelve meetings for the year.  In short, he didn't feel a necessity to attend the meetings if he was going to get paid anyway.  Here are some of my insights relating to extending insurance coverage to board members:

1.  The Wasatch County School District has paid for insurance for it's board members and has done so for quite a long time.  I don't know if they pay a payment in lieu if they chose not to take the insurance.  My wife was on the school board for twenty years and we were covered under their plan for quite a few of those years because getting insurance as a self employed person is sometimes difficult.

2.  I know that the School District, Heber Light and Power and other employers offer payment in lieu to employees if they have other coverage from a spouse (or other circumstances), so the idea certainly is not a new one.

3.  I served on the Heber Light and Power in 2008 and 2009.  Unlike what's been said about the length of meetings, etc, meetings were seldom less than an hour and a half.  During my two previous years, I probably attended six to ten additional meetings regarding legal issues and other matters of board business.  I also spent one to three hours per month reading over my packets for the meetings and doing research so that I was prepared for meeting.  The payments were for each month, not for each meeting.

I will get back to you when I know more.  I don't intend to shirk my duty as a Council member.  I hope that you can appreciate what I have told you.  You expect an answer and I will always respond.  However, I trust that I will not be quoted out of context and make headlines in the paper or on the radio because of things I have said.

With warm regards,

Jeff Bradshaw

Dear Councilman Bradshaw:
Thanks for your response.  Thank you for the time and effort that you have taken to address my concerns.  That goes a long way with me.

To me, the big issue here is the Heber Light & Power Board’s attempt to push a “huge” benefit through for themselves and trying to keep it below the radar screen.  That was disingenuous and unethical in my view.  In addition, the question isn’t whether or not a health care benefit should be the same as the School Board’s, the question now presents itself, should the school board get a health benefit????  Have you ever heard any candidate disclose in their candidacy for any office (including the school board) that one of the reasons they were running for office was to secure for themselves healthcare benefits?  I haven’t.  Time spent at every elected office varies and quite honestly I have no idea how much the school board members get paid,  nor how much the City Councilmen get paid, and I have no idea how much the other municipal boards in the county and water districts get paid.  However, from now on that will be something that we will find out and disclose.  Compensation packages for elected officials should be openly and fully disclosed on each entity’s website and any attempts to increase compensation should be fully disclosed to the public, included in a meeting with the topic being fully discussed, and the public should be able to weigh in on any votes to increase that compensation.  Then, the entire compensation package, including fees from sitting on any other boards or committees, should be disclosed on the page that identifies the elected officials.  If we want a transparent and ethical government, that is the way to produce it.  Not attempting to get paid below the table so to speak and keep issues from others so they might never find out.  You have heard more from this constituent than you ever wanted to so I’ll quit.  Just know that this action has caused the watchdogs to come out of their caves.

Sincerely,

Bruce Heywood

Mr Heywood,

As you no doubt have heard, the Heber Light & Power Personnel Committee has
met and revisited the increase that that they recommended and was passed
last November.  They will be recommending to the full Board of the Heber
Light & Power Company that the insurance benefit for Board members be
discontinued.  As a member of the Board, I will vote for their
recommendation.  I believe that is the right decision.  After having
discussed the issue with the board members, I don't honestly think that the
rate increase put into place earlier in the year had anything to do with the
benefit.  I also don't think that an increase would be necessary to fund the
benefit.  That is the way the board felt when then passed the issue in
November.  My other thoughts about Heber Light & Power are:

1.  Heber City owns 75% of the power company.  Midway owns 12.5% and
Charleston owns 12.5%.  The power company is a separate entity from the
cities.  It is governed by their board of directors.  The by-laws clearly
spell out that the mayors of Heber, Midway, and Charleston serve on the
board along with two Heber City council members.

2.  Board members have been compensated for their service on the board for a
very long time.  Although I don't know when the compensation started, I'm
sure that it was over 40 years ago.

3.  Most cities that have power companies, such as Provo, provide power for
their citizens and own the company 100%.  As such, the power companies
operate as a department of the city, such as our water and sewer dpartments.
I believe that you would find that utility companies that provide services
to multiple entities pay their board members some sort of renumeration.

4.  Heber Light & Power has regularly paid dividends to its owners and has,
in fact, increased its dividends amount to the cities fairly recently.

5.  I feel that repayment of monies for the above-mentioned benefit by board
members is an issue that each board member (and council member in the case
of Heber City) has to decide upon.

Dear Councilman Bradshaw:

Thanks for your reply to my email.  The issue at hand isn't compensation,
it's how the compensation is determined and paid.  There was no open public
discussion about the HPL Board member increases, no notification to members
of the public about the intentions of the Board, no analysis of "total"
public official compensation from all Boards served on, etc.  This entire
ordeal felt like it was a documentary of cronyism from New York City or
Bell, California rather than from little Heber City, UT.

I think it would be good for the City Council to post somewhere on its
website all forms of compensation that council members receive from all
sources resulting from their service to the city and any related boards.
None of the Councilmembers nor the Mayor should have anything to hide.  The
Heber Power and Light ordeal demonstrates why full disclosure is so
important in government.  If the members of HPL spend significant time in
their service and they receive just compensation, there is nothing to hide
and the community should understand fair compensation for time served.  So,
justify the compensation, disclose it, and then vote on any increases in an
open, well advertised public meeting.

Hopefully you understand where the citizens are coming from on this issue.

Sincerely,

Bruce Heywood

I hope this was informative.  I'm excited to see a councilman from Heber City respond to a concerned citizen in such a manner.  It's this type of dialogue between the public and elected officials that will move things forward and always be in the best interest of our city.

I welcome your comments and emails and I look forward to seeing you at the next Heber City Council Meeting!

Thanks again,
